etrials Safe Harbor / Data Privacy Statement


The privacy of data is of paramount importance to the customers that etrials serves. etrials subscribes to standards that instill confidence and comfort in our clients and will withstand the scrutiny of any data protection authority.

We provide this position statement in response to the European Commission’s Directive on Data Protection enacted in October 1998; which among other objectives includes requirements that prohibit the transfer of personal data to non-European Union nations that do not meet their standards for privacy protection.

This Safe Harbor / Data Privacy statement outlines the steps we have taken to meet this directive. It applies to all personal information received by etrials in the United States from the European Union (EU) in electronic, paper or verbal formats.

Privacy Principles

Notice:

Where etrials collects personal information directly from individuals in the EU, we will work with our clients to inform individuals about the purposes for which we collect and use personal information. We will also disclose the types of non-agent third parties to which etrials disclosed that information if any, and the choices and means that etrials offers individuals for limiting the use and disclosure of their personal information.

This notice will be provided in clear language in a conspicuous manner at the same time individuals are first asked to provide personal information to etrials, or as soon as possible thereafter, and in any event before etrials uses or discloses information for a purpose other than that for which it was originally collected.

Choice:

etrials will provide individuals with the opportunity to choose (opt out) whether personal information is disclosed to a third party agent used by etrials; or to be used for a purpose other than the purpose originally authorized.

For sensitive personal information or use of personal information for a purpose other than the purpose originally authorized, etrials will disclose the information to a third party agent only after an individual explicitly consents (opts in) to the disclosure.

etrials will provide the means to opt out and opt in.

Transfers to Third Parties:

We will enter into a written agreement or contract to ensure that our agents or third party providers adhere to the same level of privacy protection as etrials.

Access:

Upon request, etrials will allow individuals access to personal information that we hold. Individuals can correct, amend, or delete information that is inaccurate; except in certain cases where providing this access would be disproportionate to the risks to the individual’s privacy or where rights of other individuals would be violated.

Security

etrials takes precautions to protect personal information from loss, misuse and unauthorized access, disclosure, alteration, and destruction.

Data Integrity:

etrials works with our client sponsors to ensure that personal information collected is relevant for the purposes for which it is to be used. We use the data only for the purposes that it was originally collected or authorized by the individual. We will work with our clients to take reasonable steps to ensure that personal information is relevant to its use, that the data is accurate, complete and current.

Enforcement

etrials will conduct compliance audits of the relevant privacy practices to verify adherence. Any employee that etrials determines is in violation of this policy will be subject to disciplinary action, up to and including termination.
